Lederer, Ferguson named in Full Tilt investigation

12-April-2010

FinancialTimes.com reported last week a Manhattan federal grand jury is investigating FullTiltPoker.com and several professional poker players in connection with offering online poker to U.S. residents. The grand jury issued a subpoena, the news Web site said, to determine whether those named violated U.S. gambling and money-laundering laws.

Among the professional poker players named in the subpoena are Chris Ferguson and Howard Lederer. Both World Series of Poker champions were accused in a civil lawsuit filed last year of controlling Full Tilt Poker.

Online gambling has been illegal in the U.S. since 2006, when President George W. Bush signed the Unlawful Internet Gambling Enforcement Act into law. However, critics say the law is too vague and places unrealistic burdens on financial institutions.

Several lawmakers, most notably Rep. Barney Frank, D-Mass., have proposed legislation that would overturn the UIGEA. Yet it is unlikely any of the bills will become law before the UIGEA's June 1 implementation date.

Those familiar with last week’s inquiry told the Financial Times that FBI agents or prosecutors have “spoken to at least two people involved in disputes with Full Tilt Poker.” Specifically, FinancialTimes.com said, investigators are looking into possible money-laundering violations in order to gain the cooperation of authorities in countries where online gambling is legal.

Eric Jackson, a Los Angeles civil attorney representing Lederer, Ferguson and a Full Tilt software provider, told the Financial Times that authorities had not informed his clients of the inquiry.

"We are not going to comment about a speculative grand jury investigation that we are not aware of," Jackson said.

Though both Lederer and Ferguson have filed a motion to dismiss the civil lawsuit, neither has commented on the plaintiff’s allegations.
