Unprecedented ruling in New York

Gambling911.com reported Tuesday that its parent company, Costigan Media, won its case to have warrants related to recent government money seizures unsealed. The documents pertain to nearly $40 million in funds currently frozen at the behest of federal authorities.
Judge Laura Taylor Swain ordered the warrants unsealed. However, she also allowed prosecutors to redact some information the documents contain. Specific redactions, Gambling911 said, include “names of individuals.”
The documents detail a federal investigation into transactions authorities say violate U.S. gambling laws. The U.S. Attorney’s office for the Southern District of New York instructed three banks – Citibank, Goldwater Bank and Alliance Bank of Arizona – to freeze the accounts of online poker operators Full Tilt Poker and Poker Stars.
In a letter dated Friday, Assistant U.S. Attorney Arlo Devlin-Brown asked Alliance Bank to treat the frozen funds as if the FBI had “legally seized” them. June 24, bureau Special Agent Dana Conte swore to two other affidavits ordering the seizure of funds from California branches of Union Bank and Wells Fargo.
PokerNewsDaily.com editor Tom Jenkins speculated that the Southern District of New York’s indictment of Canadian Douglas Rennick might have influenced Swain’s decision. U.S. authorities charged Rennick last week with one count of bank fraud, one count of money laundering and one count of illegal gambling.
According to a letter Costigan Media attorney Baruch Weiss sent Swain Saturday, “We bring the indictment to your attention because it suggests that there is no longer a need on the part of the government to keep the seizure warrant documents sealed.
”The filing of the indictment also changes the constitutional setting for the motion to unseal… All courts agree that there is some right of access post-indictment.”
At press time, Gambling911 had released no further information concerning the unsealed documents’ contents.
"We expect to have a clearer understanding of the extent of these redactions shortly as this story is still developing," the online gambling news source said.
